Does anyone know the legal position on this?

Nick's link very usefully summarises the legal position.
If you do not work in the retail or betting sectors 'the devil is in the detail' - as the saying goes. In those circumstances it is entirely a contractual matter. It is important to remember that your contract of employment consists in not just your statement of terms and conditions but also all policies, procedures and collective agreements (if there is union recognition) applicable to your post.
As an aside, the limited legal protections for retail workers were introduced as a sop to secure sufficient votes in Parliament for the big supermarkets' demand for legalisation of Sunday trading. I was a union rep in one such supermarket in the 1990s and well recall the battles!
